The topic of data protection is overwhelming, seemingly mired in bureaucracy and something that is for big business only. However, as we are increasingly reliant on data to run our businesses, even small enterprises should consider understanding data protection and make sure they have the basics in place.

The Challenge

Our client runs a small but growing business and has no prior knowledge of data protection. They were aware of GDPR, had assumed their online marketing systems would cover what was needed when it came to emailing their contacts and were displaying a privacy policy that their website designer had provided.

This may sound familiar as it’s a common approach among smaller businesses. However, our client had decided they didn’t want to continue just ticking the boxes. They wanted to understand what role they should be playing in data protection and check whether they were compliant.

The Approach

Blake Consultants stepped in to alleviate our client’s concerns by providing a comprehensive review of the their data usage, which involved examining marketing databases and identifying the necessary elements for the privacy policy.

We then guided the business through the complexities of the allowable reasons for processing data, explaining the three scenarios under which they could market to their connections:

  • Consent – where contacts have subscribed or opted in
  • Contract – where an existing contract exists
  • Legitimate interest – opt out marketing, where it doesn’t undermine the contact’s rights

 

These elements of data protection are really the tip of the iceberg, which a huge amount more sitting beneath them. However, for many small businesses they are the critical first steps to be taken in understanding the importance of data protection.
